Executor vs. Administrator in California Probate: What’s the Difference?

When someone passes away without a trust in California, their estate often needs to go through probate—a court-supervised process that can be confusing and time-consuming. One of the first questions people have is: What’s the difference between an Executor and an Administrator?

Let’s break it down using a fictional family to help illustrate the differences.


Meet the Hamilton Family

Scenario 1: Executor – When There’s a Will
James Hamilton passed away with a valid will. In his will, he named his daughter, Rebecca, as the person he wanted to manage his estate.

Since James had a will, Rebecca becomes the Executor. She’ll still need to be formally appointed by the probate court, but her authority comes from the will.

James’ will also stated that Rebecca doesn’t need to post a bond. Because of that waiver, she can move forward without having to secure one—unless the court requires it for another reason.


Scenario 2: Administrator – When There’s No Will
In a different case, James’ cousin, Carol, passed away without a will. She had a home and some savings, but no estate plan in place.

Carol’s son, David, wants to handle her affairs. Since Carol didn’t name anyone in a will, David must petition the court to be appointed as the Administrator of her estate.

Because there’s no will to waive the bond, David will need to obtain one—unless all of Carol’s heirs agree in writing to waive the bond requirement.


What Do Executors and Administrators Have in Common?

  • Both Rebecca (Executor) and David (Administrator) will need approval from the probate court before taking any action.
  • Both will be responsible for locating and managing assets, paying off debts, notifying beneficiaries or heirs, and distributing what’s left.
  • Both must act in the best interest of the estate and are legally required to follow court procedures carefully.
